NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
The 2011 Tennis Night in America Sweepstakes (the "Sweepstakes") is intended for play in the 50 United States and District of Columbia only and shall be construed and evaluated according to United States law. Do not enter this Sweepstakes if you are not a legal resident of and located in the United States or the District of Columbia at the time of entry. This Sweepstakes is open only to legal residents of the United States and the District of Columbia who are 18 years of age and older. Void outside the 50 United States, the District of Columbia and where prohibited. Sweepstakes begins at 9:00 a.m. Eastern Time ("ET") on February 28, 2011 and ends at 3:00 p.m. ET on March 31, 2011.
HOW TO ENTER. To enter the Sweepstakes, visit www.tennisnight.com and complete and submit the online entry form. Online entries must be received between 9:00 a.m. ET on February 28, 2011 and 3:00 p.m. ET on March 31, 2011. Limit one entry per household. All entries become the sole property of the USTA and will not be acknowledged or returned. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization (such as a business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The authorized account holder may be required to provide proof of identity. Any other attempted form of entry is prohibited; no automatic, programmed, robotic or similar means of entry are permitted.
ELIGIBILITY. The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age and older. Employees of USTA and its subsidiaries, affiliates, parent companies, sales representatives, agents, sections, districts, advertising and promotion agencies or any other agencies or entities involved with this Sweepstakes and members of their respective families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. By participating in this Sweepstakes, participants agree to be bound by these Official Rules. The USTA reserves the right to disqualify from this Sweepstakes any person it believes has intentionally violated these Rules.
DRAWING. Winner will be selected in a random drawing on or about April 1, 2011 from all eligible entries received. Drawing will be conducted by Sponsor, whose decisions will be final and binding in all respects. Potential winner will receive an email from Sponsor and will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where permissible) within 7 days of notification in order to be confirmed the Sweepstakes winner. If prize/prize notification is returned as undeliverable, such prize will be forfeited and an alternate winner will be selected.
All of the Grand Prize Winner's guests (and a parent or legal guardian of each guest who is a minor in his/her state of residence) will be required to sign a Liability and Publicity Release (where permissible).
ODDS. Odds of winning depend upon the total number of eligible entries received.
PRIZE. One (1) Grand Prize will be awarded. The Grand Prize Winner will receive a trip for four (4) to Flushing, New York to attend Family Day at the 2011 US Open, currently scheduled to take place on one (1) day during the week of August 29, 2011. The trip includes roundtrip economy class air transportation for four (4) individuals from a major commercial airport near Grand Prize Winner's residence (as determined by the USTA) to a metro-New York airport; two (2) nights hotel accommodations (two (2) standard rooms, double occupancy); a Family Day hospitality package, which includes four (4) tickets to a US Open session, a hospitality breakfast and the opportunity to participate in other Family Day activities; ground transportation between airport and hotel and between hotel and the US Open; and US Open Event Cards with a value totaling $200 to be used for food and/or merchandise at the US Open.
Approximate retail value of Grand Prize: $3,500.
Air transportation to Flushing, NY provided only if the Grand Prize Winner resides at least 100 miles from Flushing, NY. The Grand Prize Winner and all of his/her guests must take air travel on same itinerary and must travel on dates specified by the USTA. Lost or stolen tickets, travel vouchers or certificates will not be replaced. Once booked, no change, extension, or substitution of trip dates is permitted, except by the USTA at its discretion. Each guest accompanying the Grand Prize Winner must be at least eighteen (18) years of age unless either (i) such minor guest is a child of the Grand Prize Winner or (ii) such minor guest is accompanied by his/her parent or legal guardian who is also a guest of Grand Prize Winner. The USTA reserves the right to request proof of age and parentage, and a Grand Prize Winner will be deemed to have forfeited the Grand Prize if the USTA, in its sole discretion, finds that the proof is unsatisfactory. Grand Prize Winner and his/her guests are responsible for obtaining all necessary and required travel documents.
All expenses not specified in these Official Rules, including, without limitation, taxes, insurance, additional ground transportation, additional spending money, beverages, food and merchandise at the event and all other personal and incidental costs are solely Grand Prize Winner's responsibility.
GENERAL CONDITIONS. In the event of non-compliance with any of these Official Rules, prize may be forfeited and awarded to an alternate winner. Upon verification of eligibility, prize winner will be notified by e-mail, mail and/or phone regarding the details of the prize. By accepting the prize, the winner agrees to accept the prize in the manner set forth by the USTA. The winner is responsible for all applicable federal, state, and local taxes on prize. The prize winner will be issued a Form 1099, for income verification and tax purposes, for the retail value of the prize. The winner is advised to seek independent counsel regarding the tax implications of his/her prize winnings. The USTA is not responsible if any US Open event for which Grand Prize Winner and his/her guests receive tickets is rained out, postponed or cancelled after receipt of US Open tickets for any reason, in whole or in part. No compensation will be paid in lieu of the ticket prize. The USTA reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. Prize is not transferable, assignable or redeemable for cash. By participating, entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which shall be final and binding in all respects. By accepting prize, winner releases and holds harmless the USTA, USTA National Tennis Center Incorporated, the City of New York and their respective parent companies, subsidiaries, affiliates, dealers, and the directors, officers, employees and agents of any of the above organizations (the "Releasees") from any and all liability, and the Releasees will be held harmless by winner and his/her heirs and executors for any injury including personal injury, death, loss or damages of any kind, arising from participation in or in connection with acceptance, possession, use, misuse and/or nonuse of any prize or participation and/or traveling to any prize-related activities, or any claims based on right of publicity/right of privacy. The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose. The Releasees accept no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority. Sponsor reserves the right to modify this Sweepstakes in any way it deems necessary or appropriate. Except where prohibited, by accepting prize, the winner grants Sponsor the right to use and publish his/her photograph, likeness, name, city and state of residence and/or likeness and that of his/her minor child or children for advertising and promotional purposes in any media in connection with the Sweepstakes without limitation and without additional compensation.
OTHER. USTA and its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. Sponsor and its agencies are not responsible for lost, late, stolen, illegible, incomplete, misdirected, damaged or destroyed entries or for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including, without limitation, the incorrect or inaccurate capture of entry information online. Once submitted, entries become the exclusive property of Sponsor and will not be returned. Entry material/data that has been tampered with or altered is void. If for any reason, (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor) the administration, security, fairness, integrity, or proper conduct of the Sweepstakes is corrupted or affected such that this Sweepstakes is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes or to select a winner for any remaining prize by randomly drawing from among all valid entries received, up to such time of cancellation, termination, or suspension, and/or solely from the mailed entries. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
WINNER LIST REQUESTS. MISCELLANEOUS. Participants agree that this Sweepstakes is governed solely by the laws of the United States and any claims arising out of this Sweepstakes may be brought only in a federal or state court located in the counties of New York or Westchester, New York. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
